Can I sue a designer company for “designing” me someone else’s logo?

I used an internet logo design company to specifically design me a professional logo and they gave me my copy write paperwork afterwards.
After a couple years, I went to trademark it, and it came back that someone has my exact logo already, and it’s trademarked by someone else.
It would seriously cost me over 25k to replace all marketing and advertising pieces.
I’m afraid if I don’t change, I will get sued. But at the same time, i didn’t know what I received wasn’t authentic.
Do I have a case here?
